The Jackdraw CX Index — Subscription Terms
Last updated 20 July 2026. These terms apply to The Jackdraw CX Index subscription. They are written to align with the Australian Consumer Law (ACL) and current ACCC guidance on subscriptions, consumer guarantees and unfair contract terms. Nothing here limits any right you have that cannot lawfully be excluded.
Who we are
The Jackdraw CX Index subscription (the “Subscription”) is provided by Jackdraw Consulting (ABN 77 664 368 926), a sole trader based in Melbourne, Australia (“we”, “us”, “our”). You can contact us at hello@jackdraw.com. These terms form a contract between us and you (the “Subscriber”) when you start a Subscription, and they sit alongside our Privacy Policy.
What the Subscription is
The Subscription delivers one Jackdraw benchmark report edition for your chosen category each quarter, by email. Each quarterly edition reflects the most current audit data we hold at the time of release and may include updated scores, newly added brands, revised or new sections, and refreshed commentary as the benchmarks evolve. Each edition may also include links to our latest articles and information about our other products. The reports are general information and research. They are not financial, legal or other professional advice, and they are a point-in-time assessment. You are responsible for how you use them.
Launch offer — your first quarter free
As a current launch (introductory) offer, your first quarterly edition is free. If you do not cancel before the end of your first quarter, your paid Subscription begins automatically: your nominated payment method will be charged A$2,500 (inclusive of GST) on the first day of your second quarter, and at the start of each quarter after that, until you cancel. We will make the price, the billing frequency, and the date your free period ends clear to you before you sign up. This offer is limited and may be changed or withdrawn at any time for new sign-ups. Withdrawing or changing it does not affect any subscription that has already started under it.
Fees, billing and GST
- The Subscription fee is A$2,500 per quarter, inclusive of GST (a full year is A$7,500 — your first quarter free, then three quarters at A$2,500).
- Payments are processed quarterly in advance by our payment provider, Stripe. We do not store your card details — Stripe securely stores and processes them (see our Privacy Policy).
- The Subscription renews automatically each quarter unless cancelled.
- We issue a receipt / tax invoice for each payment.
Changes to the price
We may change the Subscription fee. If we do, we will give you at least 30 days’ notice by email before the change takes effect. If you do not want to continue at the new price, you may cancel at any time before it applies, and the change will not affect you.
Cancelling your Subscription
You can cancel at any time, with no cancellation fee, using the self-service link in your subscription / receipt emails (the Stripe customer portal) or by emailing hello@jackdraw.com. When you cancel:
- your Subscription continues until the end of the current paid quarter, then stops;
- you will not be billed again;
- you keep any editions already delivered to you; and
- you will not receive further quarterly editions.
We aim to make cancelling as simple as signing up.
Refunds and your rights under the Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. Our reports and the Subscription service come with consumer guarantees that cannot be excluded under the ACL. In particular:
If the service (or a report supplied under it) has a major failure, you are entitled to cancel the Subscription and to a refund for the unused portion, or to compensation for its reduced value, and you may be entitled to compensation for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem fixed within a reasonable time, and if it is not, to cancel and receive a refund for the unused portion.
Subject to those rights, we do not give refunds for change of mind, or for quarterly editions that have already been delivered to you. For example, if you cancel after a paid edition has been sent, you are not entitled to a refund of that quarter’s fee simply because you have changed your mind — but your ACL rights above always remain. How the reports may change over time
The Subscription is a subscription to an evolving product. We may, at our discretion and acting reasonably, change the brands audited, the criteria, the structure, the sections, or the presentation of the benchmarks from edition to edition as our methodology develops. We will not reduce the core value of the Subscription without reason. If we make a material adverse change to what the Subscription delivers, we will tell you and you may cancel.
Licence and acceptable use
Each edition is licensed to you, the individual Subscriber, for your own internal use. Unless your plan says otherwise (for example, a Team plan with an internal team licence), you may not resell, republish, or redistribute the reports, or present them as your own. External citation with attribution is permitted only where your plan expressly allows it.
Availability and changes to the service
We aim to release an edition each quarter but do not guarantee a specific release date. We may modify, pause or discontinue the Subscription. If we discontinue it, we will give you reasonable notice and stop billing you.
Our liability
To the maximum extent permitted by law, and subject always to your non-excludable rights under the ACL (clause 07), our total liability to you in connection with the Subscription is limited to the amount you paid us in the 12 months before the relevant claim. We are not liable for indirect or consequential loss, or for how you choose to act on the information in a report.
Privacy
We handle your personal information in accordance with our Privacy Policy, which explains what we collect for the Subscription (including through Stripe), how we use it, and your choices.
Changes to these terms
We may update these terms. If we make a material change, we will give you reasonable notice by email before it takes effect. Continuing your Subscription after that date means you accept the updated terms; if you don’t, you can cancel.
Complaints and contact
If you have a concern, please contact us first at hello@jackdraw.com — we want to resolve it. You also have the right to seek assistance from the ACCC or your state / territory consumer protection agency (in Victoria, Consumer Affairs Victoria).
Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of that jurisdiction.
